Carson SMS Privacy Policy
This “SMS Privacy Policy” describes the privacy practices of CWM, LLC and its subsidiaries and affiliates (collectively, “Carson,” “we,” “us,” or “our”) in connection with Carson SMS text messaging programs, including marketing and service-related text messages delivered through vendor-operated SMS applications (collectively, the “SMS Service”). Affiliates include entities operating under the Carson, CWM, or other Carson Group Holdings, LLC-owned names; financial companies such as broker-dealers, investment advisory firms, and insurance companies; and nonfinancial companies such as coaching and wealth management services providers. This SMS Privacy Policy also describes your rights and choices with respect to the personal information we collect in connection with the SMS Service.
Information We Collect Through SMS Communications. We collect personal information in connection with your participation in our SMS Service. This information may include your mobile phone number, your name if provided, the date, time, and method of your opt-in, message content, delivery information, and your opt-out preferences. We retain opt-in and opt-out records as required for legal and compliance purposes. Our business customers may transmit personal information to us as part of services we provide through vendor voice and messaging platforms. This SMS Privacy Policy does not apply to personal information that we process solely on behalf of our business customers. Our use of such personal information is restricted by our agreements with those business customers. If you have concerns regarding personal information processed on behalf of a business, you should review that business’s privacy policy and direct your concerns to them.
How We Use SMS Information. We use the personal information collected through the SMS Service to communicate with you about your account, services, marketing offers, and other relevant information, to maintain records of consent, to comply with legal and regulatory requirements, and to support and improve our messaging programs.
Consent to Receive Text Messages. By opting in to receive SMS messages, you consent to receive text messages at the mobile number you provide. Where required by law, marketing SMS messages are sent only after obtaining your prior express written consent. Consent to receive marketing text messages is not a condition of purchasing any goods or services. Message frequency may vary, and message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages.
No Sharing of Mobile Information. We do not sell your personal information. We do not share end-user data for third-party marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent information will not be shared with any third parties except vendors or service providers that support our SMS delivery and are contractually obligated to protect such information, or as otherwise required by law.
Opting Out of SMS Communications. You may opt out of text messaging at any time by replying STOP to any message. You may also contact us at [email protected]. Opting out will stop SMS communications from that particular phone number or program. You may continue to receive service-related and other non-marketing text messages from other Carson numbers, and you may opt out of those in a similar manner. For assistance, reply HELP to any message.
Your Data Rights. Based on applicable law, you may have the right to request access to, correct, or delete personal information we collect from you in connection with SMS communications. We may retain certain information as required by law or for compliance purposes, including records of your opt-out request.
Choosing not to share your personal information. Where we are required by law to collect your personal information, or where we need your personal information in order to provide the Service to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our services. We will tell you what information you must provide to receive the Service by designating it as required at the time of collection or through other appropriate means.
Changes to this SMS Privacy Policy. We reserve the right to modify this SMS Privacy Policy at any time. If we make material changes, we will update the effective date and post the revised version. Any modifications will be effective upon posting. Your continued participation in the SMS Service after changes become effective constitutes your acceptance of the revised Policy.
